Joel Thompson has been indicted by a grand jury on charges that include second-degree murder and attempted second-degree murder, both felonies. He was initially charged with felony first-degree manslaughter following his arrest in December.

Police said that the fatal hit-and-run took place at approximately 9:40 a.m. on Dec. 20 last year, when police responded to a call for a dispute in the vicinity in the area of Neppherhan and Ashburton avenues, Yonkers Police Sgt. Dean Politopoulos said.

When officers arrived on scene they found Madysen Denman, 16, of Yonkers on the ground at in a lifeless state, Politopoulos said. She was pronounced dead at the scene.

Police conducted a canvas in the area, and patrol officers were able to apprehend Thompson without further incident on Saw Mill River Road. Investigation into the fatal crash determined that  Thompson was involved in a dispute at the scene when he intentionally drove his vehicle, a blue 2006 Toyota Corolla passenger sedan, on the sidewalk in front of the Nepperhan Avenue apartment building striking Denman with his vehicle causing her death, Politopoulos said.
